Procurement Policy Memorandum 2016-05 (Revised AUG 2018) - Implementation of the Veterans First Contracting Program as a Result of the U.S. Supreme Court Decision
Purpose: This Procurement Policy Memorandum (PPM) is being revised to provide clarity and alignment with VAAR 819.7007 and 819.7008 (DEVIATION) (JUL 2016) regarding sole source awards to service-disabled veteran-owned small businesses (SDVOSB) and veteran-owned small businesses (VOSB). This PPM revises and reissues PPM 2016-05 – Implementation of the Veterans First Contracting Program as a Result of the U.S. Supreme Court Decision, dated July 25, 2016. The attachments to the PPM Class Deviation-VFCP 2016, dated July 25, 2016; and the Decision Tree Tool remain unchanged.
VAAR Sections Impacted: VAAR 819.7007 and 819.7008.
Effective Date: Immediately.
Background: VAAR 819.7007 and 819.7008 provide that a contracting officer may award a contract to a verified SDVOSB or VOSB concern using procedures other than competitive procedures when certain requirements are met. PPM 2016-05, dated July 25, 2016, provides additional guidance in addressing the justification formatting requirements as established in FAR 6.303-2.
The PPM is being revised to provide clarity and alignment with VAAR 819.7007 and 819.7008 regarding sole source awards to service-disabled Veteran-owned small businesses or Veteran-owned small businesses.
Applicability: This PPM applies to HCAs, VA Contracting Officers, and other VA acquisition professionals. Additionally, this PPM applies to all acquisitions conducted by VA or on behalf of VA utilizing Interagency Acquisitions in accordance with FAR subpart 17.5, VAAR subpart 817.5 and FAR 8.404(b)(2).
Action Required: VA acquisition workforce and other VA acquisition professionals shall comply with this PPM.
