What's Changed?

Notification of the Publication of Revised Department of Veterans Affairs Acquisition Regulation (VAAR) Parts 823, Environment, Energy and Water Efficiency, Renewable Energy Technologies, Occupational Safety, and Drug-Free Workplace; 824, Protection of Privacy and Freedom of Information; 826, Other Socioeconomic Programs; 843, Contract Modifications, and affected parts 801, 836, and 852; and New VAAM Parts M823, M824, and M843

Purpose:  To notify the VA Acquisition workforce of the publication of revised VAAR parts 823, 824, 826, 843 and their affected parts 801, 836, and 852; as well as the publication of new VAAM parts M823, M824, and M843.

VAAR/VAAM Parts Impacted:  VAAR parts 801, 823, 824, 826, 836, 843, and 852; and VAAM parts M823, M824, and M843.

Effective Date:  September 30, 2019.

Background:  In order to enhance the department level guidance for all VA acquisitions, VAAR Update Number 2008-18 dated September 30, 2019 (Insert VAAR Update link here) contains revisions to VAAR parts 823, Environment, Energy and Water Efficiency, Renewable Energy Technologies, Occupational Safety, and Drug-Free Workplace; 824, Protection of Privacy and Freedom of Information; 826, Other Socioeconomic Programs; 843, Contract Modifications, and affected parts 801, 836, and 852, that were published in a Federal Register Notice as a final rule at 84 FR 45679 (document number 2019-18524) on August 30, 2019 with an effective date of September 30, 2019, and which adopted as a final rule the proposed rule published November 28, 2018.

Due to the publishing of new VAAM part M823, the following VA acquisition policies and notices are superseded:

  1. VA Procurement Policy Memorandum (PPM) (2014-01) Compliance with the 95 Percent Sustainable Acquisition Goal under Executive Order 13514 and Federal Acquisition Regulation 23.103 and its associated Acquisition Flash! 14-06;
  2. Acquisition Policy Flash! 16-19, Contracting for Electronic Product Environmental Assessment Tool (EPEAT®)-Registered Products, dated August 8, 2016; and
  3. Acquisition Policy Flash! 15-18, Reporting Requirements for Purchases of Biobased Products, effective October 1, 2015.

Applicability:  This notification is directed to the VA acquisition workforce.

Action Required:  Comply with the requirements of the abovementioned revised and affected VAAR part, and new VAAM part.
