Tracking Implementation of Executive Order 14042
Purpose: The purpose of this Acquisition Policy Flash is to notify the VA acquisition workforce of the requirement to report contractor compliance with COVID Safety Protocol as directed by Executive Order 14042.

Background: We seek to support transparency in connection with the implementation of Executive Order (E.O.) 14042, Ensuring Adequate COVID Safety Protocols for Federal Contractors, and the implementation of guidance for contractors issued by the Safer Federal Workforce Task Force. Central collection of data will support federal-wide analysis of implementation progress and visibility into the steps taken to safeguard workers.
Applicability: This Acquisition Policy Flash applies to all VA acquisition workforce members.
Action Required: When reporting awards and modifications issued on or after September 30, 2021 that implement the Task Force’s COVID-19 safety protocols to the Federal Procurement Data System (FPDS), enter “EO14042” (with no spaces or punctuation breaking up the EO identifier) at the beginning of the Description of Requirement data field on the contract action report (CAR) if the action being reported is (1) a new award (contract or order) that includes the required new clause; or (2) a modification to an existing award (contract or order) that incorporates the new clause. Additional information shall be entered into the Description of Requirement field after the identifier with no further restrictions on spaces or punctuation to provide the actual description of the requirement for either the contract or the specific modification depending on the purpose of the modification.
Contracting activities that have issued modifications or awards prior to the issuance of this instruction and on or after September 30, 2021 should update their records in FPDS by December 1, 2021.
The National Interest Action (NIA) Code for COVID (code P20C) should not be entered unless the award itself was issued in response to the pandemic.
