Requirement to complete Disclosure Agreement for non-competitive awards in VAAM Parts M806, M813 and M816
Purpose: The purpose of these VAAM updates is to include guidance regarding the requirement for all VA personnel, involved in the planning and decision making to award(s) a contract with a total contract value over the Simplified Acquisition Threshold (SAT) on a non-competitive basis, to disclose any personal or professional relationship between VA staff and offeror(s)/contractor(s) personnel. VA personnel must complete the Disclosure Agreement for Non-Competitive Requirements form and submit the completed form to the contracting officer. The affected VAAM Parts are:
- VAAM Part M806.303-170 Requirements – additional procedures
- VAAM Part M813.501 VA Special Documentation Requirements
- VAAM Part M816.505 Ordering
Effective Date: July 14, 2022.
Affected VAAM Parts: VAAM Parts M806, M813, and M816
Background: When VAAM Appendix M815-A - Department of Veterans Affairs Source Selection Guide was updated to include the requirement for the Disclosure Agreement for Non-competitive Requirements form (see Acquisition Flash 21-23), an update to the other affected VAAM parts were not made accordingly. As such, contracting officers not using the guidance of VAAM Part M815 were not made aware that the requirement applies to all awards over the Simplified Acquisition Threshold. The requirement for completion of the Disclosure Agreement form also applies to award using the procedures set forth in FAR Part 6, FAR Part 13, and FAR Part 16.
Applicability: This Acquisition Flash applies to all VA contracting activities.
Action Required: Contracting officers should review the affected VAAM parts and ensure compliance.
