Rescission of Procurement Policy Memorandum (PPM) 2016-05
Purpose: To rescind Procurement Policy Memorandum (PPM) 2016-05, Implementation of the Veterans First Contracting Program as a Result of the U.S. Supreme Court Decision.

Effective Date: September 4, 2024.
Background: PPM 2016-05 was published on 26 July 2016 to provide Veterans First Contracting Program (VFCP) guidance in response to the June 2016 U.S Supreme Court decision in the Kingdomware case. The guidance in PPM 2016-05 is outdated. The PPM includes references to the Vendor Information Pages (now obsolete) and to a temporary rule that is no longer in effect.
VAAR Subpart 819.70 and VAAM Subpart M819.70 have been updated with current and complete VFCP guidance. Since updated regulations and guidance on the VFCP have been incorporated into the VAAR and the VAAM, PPM 2016-05 is being rescinded in its entirety.
Applicability: This notice applies to all contracting activities.
Action Required: VA personnel must comply with the guidance found in the VAAR and VAAM, along with HCA-specific processes and guidance.
